Gary J. Spencer, J.D.

Gary Spencer has practiced law in California since 1970 and in Orange County since 1974.  In 1974, his practice was in product liability and insurance defense cases, whereas before that he represented plaintiffs in bodily injury cases.  His experience in both plaintiff and defense matters led him to construction defect litigation for Plaintiffs in the early ‘80s and then into defending Developers, General Contractors, Architects and Engineers in the mid-'80s thru approximately 2006.  In the mid-'80s he was requested to represent insurance companies on coverage matters concerning CGL policies, occurrence, additional insured rights and obligations, and trigger theories.  In the mid-'90’s, he was requested to act, and served, as a mediator for numerous complex litigation matters involving construction, business disputes, bankruptcy discharge rights, and insurance coverage, which he continues to do to the present. He has mediated and resolved over 50 complex cases.    He is “of counsel” to Borchard and Callahan, LLC, and consults on particular cases involving construction and insurance as requested.  He is currently reviewing coverage cases as they are decided and writing summaries and analysis for Interisk.  Gary’s full curriculum vitae is available here.

Gary has represented clients on both the Plaintiff and Defense sides over 46 years and had mediated many cases which put him in the middle of many arguments on issues that required evaluation.  He was counsel for an insurance company in the Stonewall v. City of Palos Verdes Estates case at the trial level.  That case ultimately decided many coverage issues in California involving continuous triggers, multi levels of coverage and exhaustion.

Gary graduated from the University of Southern California with a B.A in Economics and the University of California, Berkeley, with a Juris Doctor.  In 1995 he completed the multi day course on Mediation at the Strauss Institute at Pepperdine University.
